Janie Jamieson: Let’s talk about the Law…

Here’s a message sent out by Janie Jamieson Today, letting people know of an upcoming talk at the Law Society of Upper Canada, which located on 130 Queen Street West in Toronto, Ontario. The talk will be held on Tuesday August 21, from 10:00am to 12:00pm

LET’S TALK ABOUT THE LAW…
From Janie Jamieson

“ONE RULE OF LAW FOR ALL CANADIAN CITIZENS…”, has been the cry of many CANADIANS, however they are referring to the illegal imposition of their ‘law’ on sovereign nations, us the Six Nations Confederacy. The cry has also included equal treatment and application of the ‘law’ for Ogwehowe (the real people) and Canadians.

Well, let’s have it.

In CANADA all who are in ‘contempt of court’ or are ‘violating a court order’ or ‘fail to acknowledge or respect the rule of law’ are subject to arrest and detention and …

British Columbia: Nigeria North?

Three years ago the BC government sold Shell Canada drilling rights to explore for coalbed methane within Tahltan Lands, located in what’s now known as British Columbia, Canada.

The Talthan were never truly consulted in this business deal, hadn’t been informed of the dangers connected to Coalbed Methane, and in fact didn’t even known where Shell was planning to drill until they bulldozed an access road through a Tahltan trapper’s camp in the Sacred Headwaters region.

Once Shell completed drilling some test wells (in 2005), questions started to be asked about the potential impacts on water, wildlife and other matters important to the Tahltan—questions that should have been raised before any sort of deal was made–But of course the Government of BC neglected its responsibilities with regard to the rights of the Tahltan, and afterwards Shell did little to inform …

More forced evictions in Guatemala

Rights Action has just sent out some news that Skye Resources, the same Canadian mining company that ordered the evictions earlier this year, has recently ordered another eviction. This one, directed at the Mayan Q’eqchi’ community of La Paz.

From Rights Action - Residents of the Mayan Q’eqchi’ community of La Paz (municipality of Panzos, department of Alta Verapaz) are facing yet another eviction, which also threatens neighbouring community Lote 8, along with both Barrio Revolución and Barrio La Unión of the municipality of El Estor, department of Izabal.

The eviction order, filed in court case number 1745 in Cobán, was originally scheduled to take place on June 27, 2007; however, due to a substitution of the regional public prosecutor, the eviction has been rescheduled for August. While the judicial system has yet to issue an official notification of the …

Huu-ay-aht Votes in Favour of Final Agreement

On Saturday, the Huu-ay-aht voted over whether or not to support the ratification of the Maa-nulth Treaty, one of several treaties being shoved forward in the West Coast of Canada. At the end of the day, 90% voted YES, 10% NO.

That’s pretty surprising—and also cause for great concern, even if this so-called Treaty still has to be ratified by four more Nations along with the government before it becomes legal. There’s two possible reasons for this concern: One being that Huu-ay-aht have no idea what they just voted Yes on (which considering this letter, and the tactics used to have these Treaties ratified is quite possible); and two, that they do know what this treaty threatens to do, which means they would rather become a token Nation under Canada, rather then maintain themselves as their own People… because this treaty forces them to forfeit their …

Opposition to mining in Ecuador receiving death threats

This week, Amnesty International released an alert on behalf of activsts in Ecuador who are opposed to a local mining operation headed by Canada’s own Accendant Copper. According to the Press Release:

“community leader Jaime Polivio Pérez Lucero has been threatened and activist Mercy Catalina Torres Terán has been attacked, as a result of their opposition to a mining project close to their homes in the Intag area of Imbabura province, northern Ecuador. Their lives, and those of others who voice opposition to the mine, are in danger. Jaime Polivio Pérez Lucero, from Garcia Moreno parish in Imbabura, a group of villages close to a site where the authorities and a mining company are planning to excavate for copper, has received a series of death threats in recent months.”"

This comes at the same time that Ascendant Copper is …

Tsawwassen vote done. Maa-nulth vote this Saturday.

Well, the Tsawwassen vote came and went, with a 130 people choosing YES and 50 NO. Quite the difference from the previous vote, I must day. I guess bribery and misdirection does work!!!!

Now, it’s off to be ratified by the Federal and Provincial governments, which of course they’ll do hands-down. That is, unless some impressive pressure is put on them by all opposed to it… (see here for an article about the vote — but please hold any glorification you see in contempt.

Well, this Saturday another, similar vote is taking place. This one among the Huu-Ay-Aht, who will be voting on the Maanulth Treaty.

Like all the BC treaties which very quietly undermine any signatory, the Maanulth one promises to do the same… as made evident in the following letter by Dave Dennis, a member of the Huu-Ay-Aht. (Courtesy of Wasase)

An Open Letter To Huu-Ay-Aht Regarding The Maanulth

Canada lost in court on Friday. Is Canada going to learn?

In a court ruling last Friday, a Canadian Federal Court sided with the Ka’agee Tu — saying that the Federal government violated the Ka’agee Tu’s right to “meaningful consultation” when in 2005, it approved an application for Paramount Resources to drill several new oil wells in the Cameron Hills area — Traditional hunting grounds for the Ka’agee Tu, and also a location of their drinking water.

From CBC News - “The court has clearly ruled that Canada can’t make unilateral decisions about major industrial projects on aboriginal lands without, in any way, addressing or dealing with the affected aboriginal communities,” Tim Howard, a lawyer representing the First Nation, told CBC News on Monday.

“It seems that Canada needs to keep learning that lesson, and we hope that they’ll finally take it to heart this time.”

It was a second significant court …
